In a recent memorandum addressed to NOAA contractors, the Acting Director, Rafael Rivera, highlighted the implications of a lapse in federal appropriations on the National Oceanic and Atmospheric Administration (NOAA). The memo, dated October 1, 2025, informed contractors that NOAA operations, including those performed under contracts, have been limited to excepted activities due to the funding gap.
The notice emphasized that access to government facilities, resources, equipment, and systems would be restricted, with a potential unavailability of personnel necessary to administer contract performance. While NOAA contracts and purchase orders are authorized to continue to the extent they are unaffected by the appropriations lapse, certain limitations and considerations were outlined for contractors.
Supply and service contracts that are funded beyond the date of the lapse and do not require access to government facilities or active administration by government personnel may continue. However, contracts with unexercised options or partial funding may contain self-limiting terms that prohibit the performance of unfunded work. Additionally, contracts that necessitate access to government facilities, resources, or active participation of government personnel, such as those for “excepted” and “non-excepted” activities, will require individual attention.
To address specific concerns and queries, contractors were advised to consult with Contracting Officer Representatives (COR) or Contracting Officers. A list of designated contacts for various NOAA sectors, including Satellites, Weather, IT and HPC, Ships and Aircraft, Fisheries, Oceans, Atmospheric Research, and more, was provided for contractors’ reference.
The memo also outlined procedures for contracts requiring access to government facilities, resources, or active administration by government personnel, with a list maintained by government security personnel for approved access during the appropriations lapse. Contractors were encouraged to reach out to the designated Contracting Officers for further guidance and clarification on the status of their contracts.
The impact of the appropriations lapse on NOAA contractors underscores the broader implications of government funding interruptions on critical services and operations. As contractors navigate the challenges posed by the funding gap, clear communication and collaboration with NOAA officials will be essential to mitigate disruptions and ensure continued contract performance.
